Copyright Basics

Copyright provides authors of original work (e.g., written material, music, works of art, etc.), whether published or not. with a form of protection under law. This means that only the copyright owner of a work has the right to make copies of the work, distribute copies of the work, or perform or display the work. As long as the original work is in a fixed tangible form and can be communicated with the aid of a machine or device copyright applies.

However, it is important to realize that the copyright laws are defined rather broadly. Copyright does not cover the following:
  • Works not fixed in a tangible form of expression
  • Titles, names, short phrases, or slogans
  • Ideas, procedures, methods, concepts, or principles
  • Works consisting entirely of common knowledge (e.g., standard calendars, tape measures and rulers, or lists or tables taken from public documents)

Fair Use

Fair use involves situations in which copy-protected materials can be used without the copyright owner's explicit permission. The amount of material that may be used in this way is limited, i.e., not substantial in length (e.g., a fairly short quotation or excerpt), though there are no explicit, legal specifications for when or how much you can copy. There are only guidelines. Here is a link Copyright Website's Fair Use section (http://www.copyrightwebsite.com/info/fairUse/fairUse.asp) which provides specific information regarding fair use. It indicates that the Fair Use provision of the U.S. Copyright Act identifies four factors that should be considered when determining fair use:
  • The purpose of the work
  • The nature of the work
  • The amount of the work used and how substantial the portion is
  • The potential impact on the marketplace value of the work

Basically, the factors outined above are quite subjective and it seems the most important aspect when determining whether a use is "fair", is whether it effects commercial value. This means that if too much of a work is copied that it affects the motivation to buy the complete work, then the use is not fair because it has impacted the marketplace value of the work. Another aspect is the purpose and character of the material used and these cover:
  • Criticism
  • Comment
  • News reporting
  • Teaching
  • Scholarship
  • Research

Joyfire Publishing owns the copyright to the design and text content of this website, however rights to individual images are retained by the individual copyright owners. Some of these files may be protected by Copyright Law. The material used on the website has been used for the express purpose of education and so comes under the purposes of fair use as defined in copyright law. The Joyfire Publishing website seeks to educate and at the same time create awareness of the book "Tuning the Diamonds: Electromagnetism and Spirtual Evolution" which in itself is categorised as A Study Guide. The other point to make is that low resolution images, have little commercial value in other media formats.

In keeping with fair use policies the author and source of the content is provided below where possible as would material from any printed work. Thumbnail book covers and people photographs are not listed here even though they are most likely copyrighted.
